OVERVIEW
Welcome to DAR.
The terms “we”, “us” and “our” refer to DAR. DAR operates this website and online store, including the products, content, features and services made available through it (the “Services”). Our online store is powered by Shopify.
These Terms of Service (“Terms”), together with the policies referenced in them, govern your use of our website and purchases made through our online store.
Please read these Terms carefully before using the Services or placing an order.
By accessing or using the Services, you agree to these Terms and our applicable policies, including our Privacy Policy, Shipping Policy and Return & Refund Policy.
Nothing in these Terms excludes, restricts or otherwise affects any statutory rights you have under applicable consumer law.
SECTION 1 — ACCESS AND ACCOUNT
You must be legally capable of entering into a binding contract to place an order through our website.
When creating an account or placing an order, you agree to provide accurate, current and complete information, including your email address, billing information and shipping information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.
You must not use our website or Services for any unlawful or unauthorised purpose.
We may reasonably restrict or suspend access where necessary to protect our customers, website, systems or business from fraud, misuse, security threats or unlawful activity.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, dimensions, materials and other information displayed on our website are accurate.
However, colours and appearance may vary slightly depending on your screen, device settings, lighting conditions and viewing environment.
Where natural materials such as real wood are used, variations in grain, tone and texture may occur. Minor variations may also arise through printing, framing and preparation.
These natural or minor variations do not affect your statutory rights where a product is faulty, damaged, materially different from its description or otherwise does not conform to the contract.
Product availability may change without notice.
We may discontinue products or limit quantities where reasonably necessary.
SECTION 3 — LIMITED EDITIONS
Where a product is described as a limited edition, the applicable edition information will be stated on the relevant product page.
Where applicable, edition numbers and other edition characteristics form part of the product description.
We will not knowingly sell more pieces within a limited edition than the quantity advertised for that edition.
SECTION 4 — ORDERS
When you submit an order through our website, you are making an offer to purchase the products in your order.
Receiving an automated order acknowledgement does not necessarily mean that we have accepted your order.
A contract between you and DAR is formed when we send you confirmation that your order has been accepted.
Payment must be successfully authorised before an order can be processed.
We may decline or cancel an order where there is a legitimate reason, including where:

a product is unavailable;

payment cannot be authorised;

there is an obvious pricing or product-information error;

we reasonably suspect fraudulent or unauthorised activity; or
-
we are unable to fulfil or deliver the order.
If we cancel an order after payment has been taken, we will refund the relevant amount paid.
Nothing in this section affects your statutory cancellation, refund or other consumer rights.
SECTION 5 — PRICES AND PAYMENT
Prices are displayed in the currency shown on our website.
The total amount payable, including applicable delivery charges and any taxes collected by us, will be displayed at checkout before you place your order.
Prices, promotions and discounts may change from time to time. Changes will not retrospectively alter the agreed price of an order that has already been accepted, except where an obvious pricing error has occurred and applicable law permits us to correct it.
Promotions may be subject to separate terms. Where specific promotional terms apply, those terms will apply to that promotion.
You agree to provide accurate and current billing and payment information.
Payment must be successfully authorised before we can process your order.
For international orders, customs duties, import taxes or other local charges may apply. Where these are not collected by us at checkout, they may be payable by the recipient.
SECTION 6 — READY-TO-SHIP AND MADE-TO-ORDER PRODUCTS
Some products are held in stock and available for quicker dispatch, while certain sizes or configurations are produced or prepared after an order is placed.
Products identified as Ready to Ship are normally dispatched within 1–3 business days.
Made-to-order pieces normally require approximately 7–10 business days for production and preparation before dispatch.
Preparation may include fine-art printing, framing, inspection and secure packaging.
Production and preparation times are separate from carrier delivery times.
A standard product being printed, framed or otherwise prepared after an order is placed does not, by itself, mean that it is personalised or exempt from statutory cancellation rights.

SECTION 7 — SHIPPING AND DELIVERY
Available shipping methods, applicable charges and estimated delivery times are displayed at checkout and/or described in our Shipping Policy.
Delivery estimates begin after dispatch unless expressly stated otherwise.
Selecting Express Delivery does not shorten the production or preparation period for a made-to-order piece. Express Delivery applies to the carrier delivery period after dispatch.
We will take reasonable steps to meet the stated delivery timeframes. Delivery may occasionally be affected by circumstances outside our reasonable control, including courier disruption or customs processing.
Where required by applicable consumer law, we remain responsible for goods while they are in transit until they come into your physical possession, or the possession of a person identified by you to receive them, subject to any applicable legal exceptions.

SECTION 8 — CANCELLATIONS, RETURNS AND REFUNDS
Returns, cancellations and refunds are governed by our Return & Refund Policy and applicable consumer law.
For eligible online purchases, UK consumers generally have the right to notify us that they wish to cancel within 14 days after receiving the goods, without having to provide a reason.
After notifying us of an eligible cancellation, you must generally return the goods within a further 14 days.
Where required by law, an eligible refund will include the basic cost of standard outbound delivery. If you selected a more expensive delivery method, such as Express Delivery, we are not required to refund the additional amount above the cost of our standard delivery option where applicable law permits.
Where permitted by law and communicated before purchase, you may be responsible for the direct cost of returning goods following a change-of-mind cancellation.
Different rights and remedies apply where goods are faulty, damaged, not as described or otherwise fail to conform to the contract.
Nothing in these Terms or our Return & Refund Policy limits your statutory consumer rights.
SECTION 9 — PERSONALISED AND BESPOKE PRODUCTS
A standard product is not treated as personalised merely because it is printed, framed or produced after an order is placed.
If we offer genuinely personalised or bespoke products in the future, including goods made to a customer's individual specifications or clearly personalised for that customer, different statutory cancellation rules may apply.
Where a statutory cancellation exception applies to a personalised or bespoke product, this will be made clear before the relevant order is placed.
SECTION 10 — DAMAGED, FAULTY OR INCORRECT PRODUCTS
Products supplied by us must comply with applicable consumer law, including requirements relating to satisfactory quality, fitness for purpose and conformity with their description.
If your product arrives damaged, is faulty or you receive an incorrect product, please contact us as soon as reasonably possible at dareditions@gmail.com.
Providing your order number and photographs of the product and packaging may help us investigate shipping damage and resolve the issue more quickly.
Nothing in these Terms limits your statutory remedies in relation to faulty, damaged or misdescribed goods.
SECTION 11 — INTELLECTUAL PROPERTY
Unless otherwise stated, content available through our website, including DAR branding, artwork and designs owned or licensed by us, photographs, graphics, text, video, audio and website content, is owned by or licensed to DAR and is protected by applicable intellectual property laws.
You may access our website for personal and non-commercial use.
You must not reproduce, distribute, commercially exploit, modify, republish or otherwise use protected DAR content without our prior permission, except where permitted by law.
Nothing in these Terms transfers ownership of our intellectual property to you.
Third-party names, trademarks and intellectual property remain the property of their respective owners.
SECTION 12 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
Our website may provide access to tools, payment services, applications or other functionality supplied by third parties.
Third-party services may be subject to their own terms and privacy policies.
We are not responsible for the independent acts or omissions of third-party providers where those matters are outside our reasonable control.
Nothing in this section excludes or restricts liability where doing so would be prohibited by law.
SECTION 13 — THIRD-PARTY LINKS
Our website may contain links to websites or resources operated by third parties.
We do not control independent third-party websites and are not responsible for their content, availability or practices.
If you choose to purchase products or services directly from a third party, that transaction may be governed by the third party's own terms and policies.
Nothing in this section affects any responsibility we have under applicable law.
SECTION 14 — RELATIONSHIP WITH SHOPIFY
DAR is powered by Shopify, which provides the ecommerce infrastructure that enables us to operate our online store.
Products purchased through the DAR store are sold by DAR. Shopify is not the seller of DAR products.
Your purchase contract for DAR products is with DAR, subject to these Terms and applicable consumer law.
Nothing in this section limits rights or remedies that cannot lawfully be excluded.
SECTION 15 — PRIVACY
Personal information collected through our Services is handled in accordance with our Privacy Policy and applicable data protection law.
Because our online store is hosted by Shopify, Shopify may process certain personal information in connection with providing its ecommerce infrastructure and related services.
Other service providers, including payment and delivery providers, may process information where necessary to fulfil orders or provide the Services.
Please review our Privacy Policy for further information about how personal information is collected, used and shared.
SECTION 16 — FEEDBACK AND REVIEWS
If you voluntarily submit a review, suggestion, comment or other feedback, you confirm that you have the right to provide that content.
You grant us permission to use, reproduce and display feedback you submit where reasonably necessary to operate, improve or promote DAR and our products.
We may moderate or remove content that we reasonably believe is unlawful, fraudulent, abusive, defamatory, infringing, misleading, obscene or otherwise inappropriate.
You must not submit content that infringes another person's intellectual property, privacy or other legal rights, contains malicious software, or falsely represents your identity or experience.
Any processing of personal information contained in feedback or reviews remains subject to our Privacy Policy and applicable law.
SECTION 17 — ERRORS AND INACCURACIES
We make reasonable efforts to keep information on our website accurate and current.
Occasionally, information may contain typographical errors, inaccuracies or omissions relating to matters such as product descriptions, prices, availability, promotions or delivery information.
We may correct genuine errors and update website information.
If an error materially affects an order you have already placed, we will contact you where appropriate and explain the available options.
We will not use this provision to remove or reduce rights you have under applicable consumer law.

You may use the Services only for lawful purposes.
You must not use the Services to engage in unlawful, fraudulent or malicious activity; infringe intellectual property rights; unlawfully collect personal information; distribute malware; impersonate another person; send spam or phishing communications; gain unauthorised access to our systems; interfere with the security or proper operation of the Services; or circumvent reasonable technical protections.
We may take reasonable steps to restrict or suspend access where we reasonably believe these Terms have been materially violated.

Automated systems, bots, agents, crawlers or similar technologies must not be used to circumvent security measures, access restrictions, CAPTCHAs or other technical controls applied to the Services.
We may reasonably restrict automated access where necessary to protect the security, availability or integrity of the Services.
Nothing in this section is intended to prohibit legitimate access that we have authorised or that cannot lawfully be restricted.
SECTION 20 — TERMINATION AND SUSPENSION
We may suspend or terminate access to some or all of the Services where we have a legitimate reason to do so, including material breach of these Terms, fraud, unlawful activity, misuse or a security threat.
Termination or suspension of website access does not remove rights or obligations relating to an order or contract already entered into, except where permitted by applicable law.
Provisions that by their nature should continue after termination will continue to apply where appropriate.
SECTION 21 — WARRANTIES AND CONSUMER RIGHTS
We aim to provide accurate information and maintain the availability and security of our website, but we cannot guarantee that website access will always be uninterrupted or error-free.
Nothing in these Terms excludes or restricts legal requirements applicable to products sold to consumers.
Products supplied by us must meet the standards required by applicable consumer law, including requirements that goods are as described, of satisfactory quality and fit for their intended purpose where applicable.
Your statutory rights are not replaced by these Terms or by any voluntary warranty provided by us.
SECTION 22 — LIABILITY
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot legally be excluded for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of statutory consumer rights.
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or losses for which we are not legally responsible.
Nothing in this section excludes or restricts rights or remedies provided to consumers by applicable law.
SECTION 23 — SEVERABILITY
If any provision of these Terms is determined by a competent authority to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or, where appropriate, severed.
The remaining provisions will continue in effect.
SECTION 24 — WAIVER
If we do not immediately exercise or enforce a right under these Terms, this does not mean that we have waived that right.
Nothing in this section overrides rights or protections provided by applicable consumer law.
SECTION 25 — ASSIGNMENT
You may not transfer your rights or obligations under these Terms where doing so would materially affect our rights without our consent.
We may transfer our rights or obligations where permitted by law, provided that doing so does not reduce your rights or protections under these Terms or applicable consumer law.
SECTION 26 — GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere, nothing in these Terms deprives you of mandatory consumer protections that apply to you under the laws of your place of residence where those protections cannot lawfully be excluded.
The courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms, subject to any rights a consumer may have under applicable law to bring proceedings in another competent jurisdiction.
SECTION 27 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices or applicable legal requirements.
The current version will be published on this page.
Where required by law, we will provide appropriate notice of material changes.
Changes will not retrospectively alter the terms applicable to an order that has already been accepted unless required by law or agreed with you.
